By downloading an image file, the user confirms this Usage Rights Agreement and the contractual penalty in the event of violation of these conditions:

Leineweber GmbH & Co. KG (in the following: Leineweber) is the owner of all usage rights to the photo files presented in the download section. In addition, it has the consent of the displayed models to use the image files to the extent displayed here. Therefore, the image files may only be used to the extent approved here. Any other use must be agreed in writing. Ms. Carolin Feigl (carolin.feigl@brax.com) is at your disposal in this regard.

1. The user is hereby granted the right to use the image files expressly offered for download in this download section free of charge for advertising the Leineweber brands (BRAX, EUREX, RAPHAELA, PERMA, BRAX Golf, etc.). To this end, the user receives a simple and non-transferable right of use. The right of use is granted for 12 months from the day of download. The image files may be used in particular for mailing campaigns, newspaper or flyer advertising as well as for the company's own internet presence, as long this is to promote the Leineweber brands. The image files may also be used for press reports in connection with Leineweber brands. The "BRAX Feel good" logo must always be reproduced on the image files with each use.
2. In particular, the image files must NOT be used
   • to advertise several brands, even if the Leineweber brands are mentioned together with the other brands.
   • if the image files are not displayed with the Leineweber trademarks.
   • as image pictures on the website or in an advertising brochure, without the advertising making exclusive reference to the Leineweber brands.
   • outside Germany (in the case of websites, the registered office of the user is decisive) unless Leineweber has expressly approved the specific use in writing.
3. Other image files than those shown in the download area may expressly not be used. In particular, it is therefore not permitted to use image files published elsewhere (e.g. BRAX website or BRAX web shop) unless express written permission has been granted by Leineweber.
4. The image files may not be changed significantly. This does not apply to details that are necessary for the presentation of the image data. The proportions must not be changed. Distorting changes are not permitted. It is also not permitted to remove the "BRAX Feel good" logo from the image files.
5. The usage rights shall expire in their entirety as soon as the user has been excluded from the download system and informed thereof in writing by Leineweber. Leineweber shall also be entitled to terminate the transferred rights of use at any time for the future if there is reason to do so.
6. In the event of a breach of these conditions, the user undertakes to pay Leineweber a contractual penalty of EUR 1,000 per breach, with no possibility to combine several offences into a single offence. Leineweber expressly reserves the right to assert further claims for damages, in particular subsequent photographer and model fees.
